Notes from the September 17th, 2024 HOA Meeting

"FAKE!" "Antagonist" (referring to this website and myself)

Board member Ed Guahari declared this website many times as being "fake" and admonished members for posting information and questions on Nextdoor. He also confronted a member with "I've lived here for 23 years - how long have you lived here?" "12" said the member. "12. OK." said Ed.

Change of Meeting Quorum Requirements

The Ballot that was brought around by hand this summer to reduce the percentage of members present at a meeting to constitute a quorum from 50% of member households to 10% passed. Many meeting attendees complained that they were not aware and/or did not get a ballot for this. Enough "yes" votes were gathered to make this effort a success. Hopefully the yes/no tallies will be detailed in the published minutes of the meeting.

2024 Budget

Since the budget was the primary order of business, there was a great deal of discussion around it.

The HOA has $42,987.47 in the bank.

I asked "why we were spending $1000 for storage?" The answer was "signs and christmas lights".

When asked since the primary order of business for this special meeting was to discuss and vote on the delayed budget proposal and annual dues assessment, why wasnt that specified on the meeting notice, and why wasnt the proposed budget included in that mailing? The answer from the PJ Morgan representative was "A special meeting is what this is. Umm... And... If you... like... It's weird, I dont really why or who said it, but in Roberts Rules (of Order), a Special Meeting is only allowed to have 2 topics". The question as to why the Board saw fit not to share the budget with the membership prior to the vote was not answered.

This answer is total nonsense. Roberts Rules of Order says no such thing. I have the book.

What RRoO says is, in Chapter 4 under Special Meetings,

A special meeting is a separate meeting held at a time different from that of any regular meeting, and convened only to consider one or more items of business specified in the call of the meeting. Notice of the time, place and exact purpose of the meeting must be mailed to all members a reasonable number of days in advance.

So, the Board solicted Proxy ballots for the approval of the 2024 Budget without stating that, and did not even provide a copy of that budget to the members. I scanned the budget document provided at the meeting, and have posted a copy here.

General Observations

The membership in attendance seemed generally dissatisfied with the overall actions of the current board, though a wide majority (myself included) supported the adoption of the budget and officially set the 2024 dues amount at $180.00. I hope that they do a better job of following the covenants for the 2025 budget. If they need help, I've outlined the process below. Though it might be fake - I dont know. I think that the service and advice being provided by PJ Morgan to be amateurish and unprofessional, which is one of the reasons I set up this site - to hold PJ Morgan accountable for the hefty fees the HOA is paying them from our dues.

Process for assessing dues per the Covenants (Article III Section 4)
The Board adopts a Proposed Budget

This must occur at least 50 days before the beginning of the Assocation's fiscal year, which would be by about November 10.

The Board submits the Propsed Budget to the Members and sets the date for the Annual Meeting

This must occur within 30 days of the adoption of the Budget by the Board.

The Board holds the Annual Meeting and the proposed Budget (and Dues amount) is voted on

In the event the proposed budget is rejected at the annual meeting, the annual budget last ratified by the Owners shall be continued until such time as the Owners ratify a subsequent budget proposed by the Board of Directors

The Board notifies the Members of the Dues amount

This notice is in writing.


When the HOA Board hired PJ Morgan the HOA did not officially exist


From June 20 2023 until April 15 2024 Saddlebrook Homeowners Association was in a dissolved state by the order of the Nebraska Secretary of State.


"Certificate of Authority to transact business in Nebraska is revoked."

Why was this website created?

In June 2024, the Board of Directors of Saddlebrook HOA allowed the former HOA website to expire, eliminating a valuable resource for homeowners and easy access to information, including the covenants. This website will restore easy access to that information, and provide an independent source of current information.

About Saddlebrook

Saddlebrook was originally developed by Benchmark Homes. The original plat was recorded with the Douglas County (Nebraska) Register of Deeds office on August 3, 2000, consisting of 72 Villa lots and 157 Traditional lots. Later replats resulted in the current 63 Villa lots and 353 Traditional lots. While Saddlebrook is outside the city limits of Omaha, it is well within the 3-mile jurisdictional boundary.

There are two independent Homeowners Associations in Saddlebrook, one for the homeowners of the Traditional lots ("Saddlebrook Homeowners Assocation") and one for the homeowners of the Villa lots ("Villas of Saddlebrook Homeowners Association"). Each Association is an independent, not-for-profit corporation.

The maintenance of the streets (with the exception of the streets within the Villas), sewers, streetlights and traffic signs in Saddlebrook is the responsibility of Sanitary and Improvement District (SID) #446. The 5-member Board of Trustees, consisting of 5 resident property owners, is elected every 2 years.

Fire and Rescue services are provided by Bennington VFD. Law enforcement provided by Douglas County Sheriff. Snow removal from the streets is provided by Douglas County. Garbage collection is contracted by the SID and paid via property taxes.
